1. About these terms
These terms govern your use of bourkesflorist.com.au and any order you place with Bourkes Florist. Bourkes Florist is a brand of AKLC Group Pty Ltd (ABN 91 646 327 157) ("Bourkes", "we", "us"). By placing an order you agree to these terms.
2. Ordering
When you place an order you are making an offer to purchase. An order is accepted once we confirm it by email. We may decline or cancel an order if the item is unavailable, if there is a pricing error, or if we are unable to deliver to the requested address.
3. Prices and GST
All prices are in Australian dollars and are inclusive of GST. A flat delivery fee of $9.90 is added to each order at checkout. The GST component of any total is shown at checkout and can be calculated as the total divided by eleven.
4. Fulfilment
Bourkes is an online florist. We do not operate a walk-in shop in every location we deliver to. Orders are fulfilled and delivered on our behalf by professional florists in our nationwide delivery network, who hand-arrange your order fresh and deliver it to the recipient. Product images are a guide; arrangements are made by hand and may vary slightly.
5. Delivery
We offer same-day delivery when you order before 2pm on weekdays (10am on Saturdays) in the recipient’s local time. We do not deliver on Sundays or public holidays. We deliver to the address you provide; if the recipient is not available, the florist may leave the flowers in a safe place or with a neighbour, or leave a card to arrange redelivery. We do not offer live delivery tracking.
On major floral occasions such as Valentine’s Day, Mother’s Day and Father’s Day, demand is very high — we recommend ordering ahead where you can, as same-day cut-off times may be earlier on these days. Our delivery fee remains a flat $9.90 at all times, including peak periods.
6. Substitution
Flowers are a natural product and availability varies by season and location. Where a specific flower or container is unavailable, our florists may substitute an item of equal or greater value in a similar style and colour, so your recipient always receives a beautiful arrangement.
7. Cancellations and changes
To change or cancel an order, contact us as early as possible on 1300 970 379 or at [email protected].
If you cancel before your order has been dispatched to a florist, we will refund you in full — there is no cancellation fee. Once an order has been dispatched for same-day delivery it is being hand-prepared with fresh stems and generally cannot be changed, cancelled or refunded; even so, we will always do our best to help. Nothing in this clause limits your rights under the Australian Consumer Law.
8. Quality and liability
Our flowers are hand-arranged fresh to order. If an order arrives damaged or not as described, see our Returns policy for how to make a claim. To the extent permitted by law, our liability for any order is limited to the price paid for that order. Nothing in these terms excludes rights you have under the Australian Consumer Law.
9. Governing law
These terms are governed by the laws of Queensland, Australia.
